Assignment Facts
Ms. Allize Onme lost her Fourth Amendment claim. However, her 45-year-old cell mate, Hayle Saytun, is now filing a First Amendment, Freedom of Religion violation against the State Prison. Hayle is a devout Satanist, with well-established roots in the Satantic Temple going back 20 years. Specifically, Ms. Saytun wants to hold meetings in the prison chapel, focusing on the church’s Seven Fundamental Tenets. State prison officials have adamantly opposed her requests.
Assignment Instructions
Read through the Grading Criteria and the Submission Guidelines (provided below). Do not begin drafting a response until you have fully understood how it will be evaluated.
Do you know what is required and how to submit your work? If so, then let’s talk about the devil’s right to preach!
Draft a five-paragraph essay supporting the statement you chose. Use this outline to organize your five paragraphs:
Introduction of the statement you chose. Provide a very brief summary of Body-Paragraph One, Two, and Three.
Body-Paragraph One. Support your statement with a concise summary of an “Acceptable Source”. Then discuss how it applies specifically to Ms. Saytun.
Body-Paragraph Two. Support your statement with a concise summary of an “Acceptable Source”. Then discuss how it applies specifically to Ms. Saytun.
Body-Paragraph Three. Support your statement with a concise summary of an “Acceptable Source”. Then discuss how it applies specifically to Ms. Saytun.
Conclusion. Summarize your strongest “evidence” (content from sources). Conclude with a strong analysis supporting the statement you chose.
Submission Guidelines
Run your final draft through “grammerly.com” or any other “spelling & grammar” checker. Review every single item that it identified. Make the necessary corrections then save your file as a PDF or DOC file.
Submit your PDF or DOC file for grading (click on the link/title of this content box). No other file extension is to be submitted.
There are a total of THREE submission attempts. The last one submitted is the one that gets graded. Once it has been graded, you cannot use the remaining attempts to resubmit revised files. They will not be reviewed. Instead, they will be deleted to eliminate any confusion.
Every submission goes through the Safe Assign Originality review process. You are encouraged to review the highlighted material (except citations) by “clicking” on the “original source” link. If it exceeds 30%, you may review, revise, and resubmit before it is graded. Submit early to benefit from this opportunity.
If your “matched content” is 70% or higher, it will receive a zero. Therefore, if you tend to “copy, paste, and dip”, then submit your work very early in the week, download the Originality Report, review it, revise your work accordingly, and resubmit by the deadline.
Assignment Facts
Hayle and Hailz Saytun were married by the Satanic Temple in 2021, but did not have a marriage certificate filed with the state, so family law does not apply. Instead, Mr. Hailz Saytun would like to have their marriage contract void, due to conditions precedent and fraud, or, in the alternative, have the contract modified, claiming ambiguity. Ms. Halyle Saytun argues that the written contract is a complete representation of their intentions, mutually and freely agreed to, thus, fully enforceable under the parol evidence rule.
This is a copy of their signed MARITAL AGREEMENT
Hayle wants to remain bound to Hailz for all eternity, but Hailz wants to break free from this marital agreement.
Mr. Hailz Saytun makes the following claims:
Wants the court to void the contract because Hayle was not a member of the Satanic Temple when they signed the marital contract, which, according to Hailz, was a condition precedent to their marital agreement.
Wants the court to void the contract due to fraud because Hayle secretly prays to “the devil” before going to bed [Clause #4 requires the repudiation of “all Gods”]. Hayle has not admitted or denied her prayers to “the devil” but claims that her private life is none of Hailz’ business.
Wants the court to permit the introduction of evidence to define the ambiguity in “all creatures” [Clause #1] because Hayle is killing mosquitoes, which she claims deserve to die and are owed no compassion.
Together Forever?
Select which ONE of the two statements you are going to defend.
With all conditions precedent met, the written contract is a clear representation of the parties’ mutual assent and freely agreed-upon intentions.
The written contract is ambiguous, void due to unmet conditions precedent, and/or void due to fraud.

Draft a five-paragraph essay supporting the statement you chose. Use this outline to organize your five paragraphs:
Introduction of the statement you chose. Discuss your analysis of each element (i.e., a very brief summary of “Body-Paragraph One, Two, and Three”).
Body Paragraph One. Explain conditions precedent by discussing the facts and the court’s analysis from a state case. Apply the assignment facts to that case, demonstrating how the condition has been or has not been met. If conditions precedent have been met, the contract is enforceable. If conditions have not been met, the contract is void.
Body Paragraph Two. Explain fraud (as it relates to contract law) by discussing the facts and the court’s analysis from a state case. Apply the assignment facts to that case, demonstrating the existence of fraud (causing the contract to be void) or the lack of fraud (causing the contract to be enforceable).
Body Paragraph Three. Explain ambiguity (as it applies to contractual wording) by discussing the facts and the court’s analysis from a state case. Apply the assignment facts to that case, demonstrating ambiguity (parol evidence rule exception applies, allowing the introduction of evidence) or no ambiguity (parol evidence rule applies, barring the introduction of evidence).
Conclusion. Applying the assignment facts, discuss the likely outcome of each issue: conditions precedent, fraud, and parol evidence rule.
